1. About us
These terms apply to services supplied by NX Recovery Ltd, a company registered in England and Wales, company number 09318471, VAT registration GB 214 8734 21.
2. Our services
We provide roadside breakdown assistance, flatbed and lift-and-tow recovery, scheduled vehicle transport, accident and insurance recovery and auction collection services within the United Kingdom. Where we sub-contract a job to a partner operator this remains a contract with NX Recovery Ltd on the same terms.
3. Booking and quotes
All work is quoted in writing before dispatch. A quote becomes a binding contract when you confirm acceptance verbally, by text message or by proceeding with the service. The quoted price is fixed unless the situation on arrival is materially different from the description provided, in which case any change is discussed and agreed with you before continuing.
4. Payment
Payment is due on completion. We accept all major UK debit and credit cards, contactless payments and, for scheduled bookings, bank transfer. VAT is charged at the prevailing rate. Trade accounts are invoiced weekly on 30 day terms unless otherwise agreed in writing.
5. Our responsibilities
We undertake to carry out our services with reasonable care and skill, in accordance with PAS 43 and any additional applicable standards. Motorway operations are carried out by drivers holding current NHSS 17 accreditation. Our staff arrive equipped and insured for the work agreed.
6. Your responsibilities
You warrant that you are the owner of the vehicle or that you are authorised by the owner to arrange its recovery or movement. You are responsible for the accuracy of the information provided during booking. You must inform us of any modification, load, cargo or fault that may affect the safe handling of the vehicle.
7. Liability and insurance
NX Recovery Ltd carries £10 million public liability insurance, £5 million goods in transit cover and £1 million cyber liability insurance. We accept liability for damage caused directly by our negligence during a job, subject to reasonable inspection at the point of collection. Pre-existing damage noted on collection or apparent from our photographic record is excluded. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law.
8. Cancellation
You may cancel a scheduled booking free of charge up to 24 hours before the collection window. Cancellations within 24 hours are subject to a charge equivalent to 25% of the quoted price. Emergency roadside dispatches cannot be cancelled once the driver has been dispatched, however we will only charge for costs actually incurred.
9. Storage
Where a vehicle is stored in one of our secure yards, the first 24 hours are included. Beyond that, storage is charged at £18 per vehicle per night. Vehicles left uncollected for more than 30 calendar days without contact will be treated in accordance with the Torts (Interference with Goods) Act 1977.
10. Complaints
We take complaints seriously and reply to every one. Please raise any concern by phone or on WhatsApp. Where we cannot resolve a complaint to your satisfaction, you may refer the matter to the SIA-registered ADR scheme applicable to the recovery industry, details of which are available on request.
11. Governing law
These terms are governed by the laws of England and Wales. Any dispute arising from them is subject to the exclusive jurisdiction of the English courts.
